This Policy differs from our Workplace Investigation Policy, which is intended to deal with issues and allegations of misconduct between employees and provides for both a complainant and a respondent to participate in the investigatory process.

When to Use This Policy

This Policy should be used where:

  • Allegations relate to a single employee
  • It is not appropriate to involve another party (such as a complainant) in the disciplinary process
  • Concerns arise in relation to an employee's unsatisfactory performance in their role

Critical Suspension Guidelines

Suspension Must Be With Pay

In any event, an employee should be suspended WITH PAY during any investigatory process.

Warning: Suspending an employee without pay may lead to unintended consequences, such as a finding that the employer has breached their employment obligations.
